Understanding your TPD claim

TPD insurance generally provides a lump sum benefit where an injury or illness causes an insured person to satisfy the Total and Permanent Disability definition contained in their policy.

Different TPD insurance policies can use different definitions and eligibility requirements. Some focus on whether you can return to work in your previous occupation or another suitable occupation, while others may use different tests. Having a serious injury or permanent disability does not automatically mean a permanent disability claim will be successful. The definition and other requirements in the relevant policy still need to be satisfied.

Total and Permanent Disability (TPD) claims are also different from personal injury claims for damages. You generally do not need to prove that another person caused your injury or illness. Instead, your insurer assesses your claim against the terms of your TPD insurance cover and the supporting evidence.

TPD insurance through superannuation

Many Australians hold TPD insurance through a superannuation fund, sometimes without realising that superannuation insurance cover is included.

If you have changed jobs or super funds, previous accounts may also be relevant. Depending on the insurance policies you held, and when your injury or illness affected your ability to work, there may be more than one TPD policy or superannuation policy to consider.

Our TPD & superannuation lawyers in Brisbane can help review available superannuation and insurance information and identify which TPD cover may be relevant to your circumstances.

The TPD claims process

Every TPD insurance claim is different, but the process generally involves several key stages.

The first step is identifying any TPD insurance that may apply and reviewing the definition and other requirements contained in the relevant policy.

Medical records, reports and employment information may be required to show how your injury or illness affects your capacity for work and how your circumstances relate to the policy definition. Depending on the circumstances, an insurer may also request further information or a medical assessment as part of its review.

The claim forms and supporting evidence are submitted to the insurer or superannuation fund. The insurer may then request further medical, employment or other information before making a decision on your superannuation or insurance claim.

If the claim is approved, the TPD benefit is generally based on the insurance cover held under the policy. If the claim is delayed or rejected, further review or dispute options may be available.

TPD payouts and multiple insurance policies

A successful TPD claim generally results in a lump sum payment based on the amount of TPD insurance cover held under the relevant policy. There is no standard TPD payout or lump sum payout that applies to every claim.

If you held TPD insurance through more than one superannuation fund or insurer, multiple claims may sometimes be possible. Each policy is assessed separately and may contain different definitions, exclusions and insurance benefits.

Where a TPD benefit is paid through superannuation, additional rules can also affect how and when the money can be accessed.

Our TPD compensation lawyers in Brisbane can help you understand the cover and potential benefits available under the policies relevant to your circumstances.

TPD claims and other legal claim pathways

The same injury or illness can sometimes give rise to more than one legal or insurance claim.

A TPD claim is separate from a workers’ compensation claim, car accident claim or other personal injury claim. Success in one pathway does not automatically establish entitlement under another, but it can still be important to understand all of the options available to you.

If your injury or illness is work-related, you may be eligible to make a workers’ compensation claim as well as a TPD insurance claim.

Workers’ compensation claims are assessed under Queensland’s workers’ compensation system (WorkCover QLD), while a TPD claim is assessed against the terms of your insurance policy. The Personal Injury Lawyers can help you understand how these separate claim pathways may apply to your circumstances.

If your permanent disability followed a car accident or another incident caused by someone else, you may have a motor vehicle accident claim in addition to your TPD insurance claim. These claims involve different eligibility requirements, evidence and legal processes.

You may also hold income protection insurance, trauma insurance, life insurance or other disability insurance cover.

Disability insurance claims can be assessed differently from TPD claims and may provide different benefits. For example, income protection insurance may provide regular payments rather than a lump sum benefit.

Our lawyers can help identify which policies, superannuation and insurance claims or related claim pathways may need to be considered.

TPD Lawyers Brisbane – FAQs

Can I make a TPD claim for an illness as well as an injury?

Potentially. TPD insurance can apply to permanent disability resulting from an illness as well as an injury, provided your circumstances satisfy the definition and other requirements in the relevant insurance policy. Your diagnosis alone does not determine whether a TPD insurance claim will succeed. Medical evidence, your work capacity and the wording of your policy will all need to be considered.

Potentially. If you held TPD cover through multiple superannuation funds or separate insurance policies, you may be able to make more than one TPD claim. Each policy is assessed independently, so the available cover and requirements under each policy need to be reviewed. This can include separate superannuation claims where more than one account or insurer may be relevant.

Potentially, yes. If your injury or illness is work-related, you may have a workers’ compensation claim as well as a TPD claim. The claims are separate and use different eligibility tests. Our lawyers can help you understand which claim pathways may apply and how they interact.

Insurers may deny claims where they consider the policy definition or another requirement has not been satisfied. A rejected claim can also involve disputes about medical evidence, work capacity, whether insurance cover applied or how the insurer interpreted the policy.

Depending on the circumstances, you may be able to seek an internal review, provide further evidence or pursue another dispute resolution pathway. Eligible complaints involving superannuation or life insurance may also be considered by the Australian Financial Complaints Authority.

Our TPD insurance claim lawyers in Brisbane can review the insurer’s reasons and help you understand the options that may be available.

You may be able to make a TPD claim after a car accident if your injuries affect your capacity for work and you satisfy the requirements of your TPD insurance policy. You may also have a separate motor vehicle personal injury claim depending on how the accident occurred.

Different time limits can apply depending on your policy, when your disability occurred and whether you are lodging a claim, challenging an insurer’s decision or considering legal action. There is no single universal deadline for every TPD claim, so seeking advice early can help identify the time limits that may apply to your circumstances.

Complex claims can involve multiple insurance policies, several medical conditions, disputed work capacity or questions about how the relevant policy should be interpreted under insurance law.

Our Brisbane TPD Lawyers can review the policy wording, medical evidence and claim history to help identify what may be affecting the assessment and what further information may be required.

Potentially. A successful TPD claim does not automatically determine your entitlement to other benefits you may hold through superannuation or insurance.

Depending on the cover in place, there may also be income protection, trauma, terminal illness or death benefit claims to consider. Each benefit has its own policy terms and eligibility requirements, so one claim outcome does not automatically determine another.
